General Terms and Conditions of Sale
1. Generality
These general terms and conditions of sale are intended to govern the contractual relationships between SH2-240 company, its EOS For Astro store, and the Customer defined below as being the user of the site and accepting these General Terms and Conditions of Sale.
Any other conditions shall only bind SH2-240 company following its written confirmation. The information on this site is provided for guidance only and may be changed by SH2-240 company without notice. Simply placing an order on the EOS For Astro site entails the unconditional acceptance of these general terms and conditions of sale.
2. Products
The characteristics of the products offered for sale are presented on the site in the Shop page.
When ordering, the Customer is given the option to request the modification of the characteristics of certain products. The result of these modifications on the product's operation is the sole responsibility of the customer. SH2-240 company cannot be held responsible for defects resulting from these modifications.
Photographs do not fall within the contractual scope. SH2-240 company's responsibility cannot be engaged if errors have been introduced.
3. Validity duration of sale offers
Products are offered for sale until the exhaustion of stocks. For products not in stock, our offers are valid subject to availability from our suppliers.
In the event of an order of an unavailable product, the customer will be informed by email as soon as possible.
4. Product prices
The prices listed on the EOS For Astro site are expressed in Euros and are Net prices, excluding shipping costs.
They may be modified at any time without notice.
To this price, shipping costs calculated on a flat-rate basis must be added. (see our Shipping Costs page)
Shipping costs are specified on the screen at the end of the selection of different products by the customer and are reminded in the order form or the Paypal payment page that precedes the validation.
The price is payable in full on the day of the order. The prices applied are those in effect at the time of the order within the limits of available stocks and subject to typographical error or modification of the French VAT rate (or change of company status). Any change in this rate would be immediately reflected in the sales prices.
Outside the European Union or in the French overseas departments and territories, and according to the legislation in force in the delivery zone, customs fees and duties and taxes may be claimed from the Client.
5. Orders
If the customer wishes to place an order, they will fill out, according to the online indications, a form made available to them where they will include the necessary information for their identification, especially their name, first name, telephone number(s), postal and electronic address. Further information may be requested subsequently to ensure the quality and security of the delivery. All information is presented to the customer in the French language.
The customer having chosen the products presented, will be able to edit an order form for postal sending, or definitively validate their order by clicking on the "Proceed to validation and payment" button on the Paypal site to express their commitment and acceptance of the General Terms and Conditions of Sale. From this moment, the order is recorded, and an order number is communicated to the customer as well as a confirmation on the screen and/or by email. The data recorded by Paypal company constitutes proof of the nature, content, and date of the order.
No unilateral cancellation of the order will be accepted without the agreement of SH2-240 company. If, despite everything, the buyer cancels their order, the acknowledgment of the cancellation will result in compensation set at 10% of the total amount of the order including taxes and the acquisition of the deposits paid.
6. Late payment
If the customer is a professional: in application of article L. 441-6 of the commercial code, late payment penalties are payable the day following the payment date shown on the invoice in cases where the sums due are paid after this date. The rate of these penalties is three times the legal interest rate.
7. Delivery mode
Delivery is made to the address specified by the customer at the time of the order. It will be carried out by La Poste in Colissimo or Tracked Mail. It can only take place once the order has been validated by the customer and payment made in full. The possibly concerned banking payment centers will therefore have given their prior agreement to payment. In case of refusal of said centers, the order will be automatically canceled.
Moreover, SH2-240 company reserves the right to refuse any order from a customer with whom there is an ongoing dispute.
Products sent by mail or courier are protected during their preparation for shipment with the utmost care, however, SH2-240 company disclaims all responsibility for the condition of the products arrived at destination. It is up to the Customer to check the condition of the package and its contents before acceptance with the carrier or the post office. All packages travel at the risk of the recipients.
All shipments are made in the form of Colissimo with the assignment by the post office or the carrier of a tracking number transmitted to the Customer at the time of shipment. SH2-240 company disclaims all responsibility for the disappearance of packages in transit with the carrier or on the Post Office network. It will be up to the Customer to carry out the necessary steps and searches with the concerned third parties in case of loss or non-delivery of a package.
8. Delivery times
If the ordered item is available in stock, the shipping time is about 2 working days for any order placed before 1:00 p.m., and 3 days after. In case of stock shortage, the restocking time is about 2 weeks. Delivery times will only start from the date of receipt and payment of the order.
Due to its low shipping volumes, SH2-240 company only carries out one postal shipment per week, which may result in additional delivery delays.
In case of force majeure, closure of our services (holidays, congresses, demonstrations), or exceptional events (natural disaster, epidemic, strikes, lock-out, etc.) delaying or prohibiting the delivery of goods, SH2-240 company is released from any responsibility. In any case, delivery on time can only occur if the customer is up to date with their obligations towards SH2-240 company.
The customer must check at the time of delivery the good condition of the packages and, in case of damage or missing product, will specify their reservations on the delivery slip and confirm them, within three days of delivery, by phone, mail or email to and from SH2-240 company and by registered letter AR sent to the carrier itself.
No incomplete order is deliverable. SH2-240 company sends only complete orders for which all products are in stock on the day of shipment.
9. Claims
By signing the delivery slip, the customer accepts the products delivered as is and from then no claims related to damages suffered during transport will be accepted. It is the responsibility of the customer to perform all checks and make all reservations on the arrival of the equipment and to exercise, if necessary, all recourse against the carrier.
Upon receipt of the goods, the customer must immediately check their condition and conformity in relation to the contract. All claims related to a defect in the goods delivered, an inaccuracy in the quantities, or an incorrect reference compared to the order confirmed by SH2-240 company, must be made in writing within four days of receipt of the goods, failing which the right to claim will cease to be acquired.
Any return of goods requires the prior agreement of SH2-240 company. In the absence of agreement, any returned merchandise will be held at the disposal of the customer at their expense, risk, and peril, all transport, storage, handling costs being charged to the customer.
In any case, the return of goods is carried out at the expense, risk, and peril of the customer. SH2-240 company can in no case be required to compensate or cancel an order due to the impossibility of using the purchased product for a reason of incompatibility with the hardware or software already owned by the customer.
In case of an order error on the part of the customer, SH2-240 company will accept the exchange or refund of the product within 7 days. The product must be returned within 7 days in its original condition. The refund will only cover the price of the product.
In case of a refund for an order error, it will occur upon receipt of the product by SH2-240 company and the validation of the state of the product.
In case of exchange for an order error, the return costs as well as the shipping costs will be borne by the customer.
10. Billing
A detailed invoice will be sent to the customer in their package. The amount corresponding to the applicable VAT will be indicated.
11. Payment method
SH2-240 company reserves the right to request a bank check and/or an identity document and/or a proof of address from the Customer in the case where the amounts involved would be significant.
By credit card: (Carte Bleue, Visa, Eurocard, Mastercard accepted in France) by Paypal. The validation of the order by credit card constitutes a mandate to pay the price all taxes included of the order. The customer must use the Paypal service to make a payment by credit card. The payment security is ensured by "Paypal" company thanks to the SSL protocol. The customer can securely transmit the type of card (Carte Bleue, Visa, Eurocard, Mastercard), the credit card number, the validity date, and the name of the cardholder (name appearing as such on the credit card)

To protect the customer in case of stock shortages or unforeseen circumstances, payments by check are cashed only after the shipment of all the ordered products and never before, whatever the delivery times.
12. Warranty and after-sales service
All products sold at SH2-240 are guaranteed against manufacturing defects and material defects. The duration of this warranty is 1 year (from the date appearing on the invoice), except for specific indications.
All modification, de-filtering, and re-filtering services of DSLRs sold by SH2-240 are guaranteed against manufacturing defects and material defects. The duration of this warranty is 3 months (from the date appearing on the invoice).
Depending on the products and the purchase date, the repair will be carried out either by SH2-240 company or directly by the manufacturer. In case of return of equipment proving to be non-defective, transport, handling, and testing fees (at the hourly rate of €29.90) may be charged to the customer. This warranty does not cover damages resulting from accidents, misuse, or negligence.
Any return of goods requires the prior agreement of SH2-240 and the obtaining of a return number issued by it to the customer, which must be very legibly inscribed on any returned package. The return of goods is carried out at the expense, risk, and peril of the customer. Products returned by carrier without physical protection or poorly protected will not be able to benefit from the warranty, it is therefore up to the customer to ensure the protection and insurance of the or products returned during their transport.
It is up to the customer to keep packaging, accessories provided with the product as well as the possible labels affixed to the product or its packaging, and which are necessary to benefit from the warranty offered.
SH2-240 company will ensure to apply the warranty on any product returned as soon as possible. However, when the repair will require the return of the product to the producer, it cannot be held responsible for any delays due to the producer. On the other hand, the after-sales service of SH2-240 company will choose the carrier responsible for delivering the goods to the customer.
13. Right of withdrawal
From the date of delivery of your order, if you are an individual, you have a period of 7 days to exercise your right of withdrawal, and be fully refunded (including shipping costs) - the costs of returning the goods remain at your charge.
However, incomplete, used, worn, damaged, or soiled products are not taken back.
As for any other return of merchandise, the customer must previously obtain a return number from SH2-240 company by filling out the refund request form.
No refund of any kind can be claimed by the customer as long as all the goods and merchandise delivered have not been duly returned in their original condition to our services.
In accordance with ordinance no. 2001-741 of August 23, 2001, this withdrawal period is not applicable: To software, as soon as the seals are broken or the packaging opened, to consumables (paper, inks, toners, tapes and recordable CDs and DVDs, mouse pads) as soon as their packaging is unsealed.
14. Retention of title and liability
SH2-240 company retains ownership of the goods until full payment by the customer. The transfer of ownership of the products to the customer takes place at the time of full payment of the price. However, during the period from delivery to the transfer of ownership, the risks of losses, theft, or destruction are borne by the customer.
The non-performance by the customer of its payment obligations, for any reason whatsoever, gives SH2-240 company the right to demand the immediate return of the goods delivered at the expense, risk, and peril of the customer.
The customer undertakes, in the case of a judicial reorganization procedure affecting its Company, to actively participate in the establishment of an inventory of the goods in its stocks and for which SH2-240 company claims ownership. Failing this, SH2-240 company has the faculty to have the inventory established by a Bailiff at the customer's expense. The customer is prohibited from reselling, transforming, or incorporating the goods delivered as of the date of the judgment pronouncing the judicial reorganization or the liquidation of the assets of its Company. SH2-240 company may prohibit the customer from proceeding with the resale, transformation, or incorporation of the goods in case of late payment. To guarantee payments not yet made and in particular the balance of the customer's account in the writings of SH2-240 company, it is expressly stipulated that the rights relating to the delivered but unpaid goods will be carried over to identical goods from SH2-240 company in stock at the customer, without it being necessary to allocate payments to a specific sale or delivery.
15. Data confidentiality
The personal data provided by the customer is not disseminated to third parties. In accordance with law 78-17 of January 6, 1978, the customer has at any time a right of access and rectification. To exercise this right, it is sufficient to contact SH2-240 company.
To meet fiscal and legal obligations, a paper and computer copy of each invoice will be kept by SH2-240 company.
Rest assured that no financial data will be kept by SH2-240 company at the end of the transaction (account number, credit card, etc.).
16. Jurisdiction attribution
The contractual information is presented in the French language and the products offered for sale comply with French regulations.
If necessary, it is up to the foreign customer to check with the local authorities the possibilities of using the product he plans to order.
SH2-240 company cannot be engaged in case of non-compliance with the regulations of a foreign country.
For professional customers, all disputes relating to the formation, execution, and termination of contractual obligations between the parties that cannot give rise to an amicable settlement will be submitted to the jurisdiction of the Commercial Court of Colmar, France within whose jurisdiction the headquarters of SH2-240 company is located.
